Booking & Charter Terms and Conditions

1. These terms

These Booking & Charter Terms and Conditions (“Terms”) govern your booking of a trip with Nautical Adventures Belize Ltd. (“NAB,” the “Company,” “we,” or “us”). By making a booking, you accept these Terms on behalf of everyone in your party. The person who makes the booking must be at least 18 years old and have the authority to accept these Terms for everyone in the party; we will deal only with that lead booker for all changes, payments, and cancellations. Any guest travelling unaccompanied must be at least 18 on the date of departure. These Terms are separate from our Website Terms of Use, and your personal information is handled under our Privacy Policy.

2. Our products

These Terms distinguish between two types of trip, because their payment and cancellation terms differ:

  • Day Trips — day excursions that begin and end the same day (our sailing, snorkeling, and fishing tours).
  • Overnight Charters — overnight and multi-day all-inclusive crewed charters.

3. Payment

Day Trips: payment in full (100% of the total booking amount) is due at the time of booking. A Day Trip booking is not confirmed until payment in full is received.

Overnight Charters: a deposit of 50% of the total booking amount is due at the time of booking, and the final balance is due no later than 30 days before your charter start date. If the final balance is not paid by the due date, we reserve the right to cancel your booking, in which case all amounts paid to date will be forfeited.

Currency. Our prices and payments are in United States dollars (USD). Where a Belize dollar (BZD) amount is shown, it is a conversion provided for convenience only, and the USD amount governs.

Marine reserve and park fees are included. Any marine reserve, park, or comparable government fees for the trips we operate are included in your price and paid by us on your behalf.

4. Cancellations and refunds

Refunds requested by you are granted solely at our discretion. Except where these Terms expressly provide otherwise (see Section 5, where we cancel), you have no automatic right to a refund, and any refund we choose to grant is at our sole discretion.

Day Trips. Because Day Trips are paid in full at booking, amounts paid for a Day Trip are non-refundable if you cancel, except at our discretion.

Overnight Charters. Deposits are non-refundable. If you cancel an Overnight Charter:

  • More than 30 days before the charter start date: 50% of the total booking amount is forfeited.
  • 0–29 days before the charter start date: 100% of the total booking amount is forfeited.

Add-ons. Charges and fees for products, services, attractions, or excursions supplied in addition to the base trip are non-refundable.

In writing only. Cancellation and refund requests must be made in writing and cannot be made verbally. No refunds will be issued in response to verbal cancellations.

5. If we cancel or change your trip

If we cancel your trip for reasons within our control (that is, other than a Force Majeure Event or a safety decision under Section 6), you may choose either a full refund of the amounts you have paid or a reschedule or trip credit of equivalent value.

If we cancel your trip because of a Force Majeure Event or for safety reasons (Section 6), we will offer you a reschedule or a trip credit of equivalent value.

6. Weather, safety and itinerary

The safety of our guests and crew comes first. The captain has sole discretion to delay, shorten, reroute, or cancel any trip for weather, sea conditions, or safety. If we cancel a trip before departure for weather or safety, Section 5 applies (reschedule or credit). If a trip is shortened after departure for safety reasons, no refund is due for the unused portion. Wildlife sightings (for example whale sharks or rays) are not guaranteed, and the captain may substitute snorkel sites, anchorages, or itinerary for conditions; a substitution made for safety or conditions is not grounds for a refund.

7. Changes and rebooking

Any amendment permitted under these Terms is subject to a maximum of one change per booking. No refunds are due after an amendment is made.

8. Guest Release & Assumption of Risk Agreement (required)

Every guest must agree to our Guest Release & Assumption of Risk Agreement before boarding; you can read it in advance at our Guest Release page. The adult who books signs on behalf of the entire party, including any minors. Signing the Release is a condition of participation. If a guest does not agree to the Release, that guest will not be permitted to board, and no refund will be due. The Release governs the assumption of risk, waiver, and release of liability that apply to your trip; these Terms should be read together with it.

9. Health, safety and conduct

Safety briefing. Every guest must attend our pre-trip safety briefing and follow the captain’s and crew’s instructions at all times. This is a condition of participation.

Alcohol and drugs. No guest may board or take part in any in-water activity (such as swimming or snorkeling) while intoxicated. Where we serve alcohol, it is for adults of legal drinking age only and at the captain’s discretion; the captain may decline to serve, or to allow participation, for safety.

Swimming and life vests. Please tell us in advance if any guest is a non-swimmer or a weak swimmer. The captain may require any guest to wear a life vest, and may limit participation in in-water activities for safety.

Fitness and disclosure. Each guest confirms they have disclosed any condition relevant to safe participation and are not taking part against medical advice.

Minors. Minors must be supervised at all times by their responsible accompanying adult.

Conduct and removal. The captain may refuse boarding to, or remove, any guest whose conduct or condition (including intoxication) is unsafe or disruptive, without a refund.

Medical care in remote locations. Our trips operate in remote marine areas. Professional medical care, rescue, and evacuation can be limited or significantly delayed — this is a real condition of operating in Belize’s waters, and every guest accepts it as part of the trip. Insurance does not change the availability or speed of medical care or evacuation on site (see Section 11).

10. Passenger information and travel documentation

For Overnight Charters, we collect each guest’s name as shown on their passport, passport number, country of issue, and passport expiry date, in connection with overnight travel and any applicable Belize immigration or reporting requirements. You must provide complete and accurate passenger information by the time we request it. If you do not, we may be unable to carry you, and this will be treated as a cancellation by you. We do not collect passport details for Day Trips.

You are responsible for ensuring that every guest holds a valid passport and any visas required for travel to and within Belize; many countries require a passport valid for at least six months. Passports, visas, and entry permits are each guest’s responsibility and cost. We cannot accept responsibility for a guest who is denied entry, or who incurs a cost or fine, because of missing or invalid travel documentation, and no refund is due in that case.

11. Insurance

We maintain the public liability insurance required for our operations. We strongly recommend that you purchase your own travel insurance covering trip cancellation and interruption and the cost of medical care and emergency evacuation, because our refunds are limited (Section 4). Please note that such insurance covers cost only; it does not increase the availability or speed of medical care or evacuation in remote areas (see Section 9).

12. Liability

Our maximum liability to you, for any reason, is limited to the amount you paid to us for the trip. Certain activities offered in connection with your trip are operated by independent contractors; the contract for any such activity is between you and that third-party provider, and we are not liable for it. Nothing in these Terms limits any liability that cannot be limited under the laws of Belize. The waiver, release, and assumption of risk in the Guest Release (Section 8) also apply.

13. Force Majeure

We are not liable for any failure or delay in performing our obligations caused by a Force Majeure Event. A “Force Majeure Event” includes acts of God; perils of the sea, harbors, rivers, or other navigable waters; act of any governmental or ruling authority; epidemic; collision; stranding; fire; war; hostilities; riots; strikes or labor stoppages; and the occurrence of any pandemic, epidemic, or prevalent disease or illness with an actual or probable threat to human life. Where a Force Majeure Event causes us to cancel, Section 5 governs the remedy.

14. Claims and time limits

Written notice of any claim, including a complete factual account of the basis of the claim, must be delivered to us within 180 calendar days from the date of the incident. No suit may be maintained unless commenced within one (1) year from the date of the incident.

15. Governing law and jurisdiction

These Terms are governed by the laws of Belize, and the courts of Belize have exclusive jurisdiction over any dispute relating to your trip or these Terms. This is consistent with our Guest Release, Website Terms of Use, and Privacy Policy.

16. Vessel condition and damage

You may inspect the vessel and its equipment before departure to confirm everything is present and in good working order. You and your party are responsible for returning the vessel in the condition in which it departed, subject to normal wear and tear. If you or your party cause damage or loss to the vessel, its equipment, or a third party’s property, you are liable for that damage; where the damage results from gross negligence or reckless conduct, you are liable for the full extent of the loss. If damage renders the vessel unfit for charter in our reasonable opinion, we may withdraw it, and no replacement, refund, or compensation will be due.

17. Our operating credentials

We operate under a Belize Tourism Board tour-operator license and Belize Port Authority vessel registration, and we maintain public liability insurance.
