BOOKING TERMS AND CONDITIONS
Please read these booking terms and conditions carefully; they form an important part of the contract for your charter package. 

Your charter package will be operated by Nautical Adventures Belize, Ltd., registered at Main Street, Placencia Village with an address for the administration of paperwork at Main Street, Placencia Village All references to "Nautical Adventures Belize", "the Company", "we", "us" or "our" shall, as applicable will be a reference to Nautical Adventures Belize, Ltd. and its affiliates, owners, officers, agents and employees, as well as the named yacht or substitute yacht, including its master and crew.

The payment of your initial deposit and the acceptance of your signature to these Terms and Conditions (this "Agreement" or these "Terms and Conditions") by us creates a contractual relationship between the Company and you, the lead charterer or passenger of the yacht provided by the Company (individually and for and on behalf of the other passengers of the yacht, and hereinafter collectively referred to as "you", the "Charterer" or the "Passenger"). Please read the following information carefully. It is a condition of your booking being confirmed that you have accepted these Terms and Conditions online during your booking process, or within 72 hours of paying your initial deposit. Should you fail to do so we reserve the right to cancel your booking immediately in which case we will refund any sums paid by you and have no further liability or obligation towards you. Alternatively, you must indicate your acceptance of this Agreement by signing and returning this Agreement to the Company by mail to Main Street, Placencia Village Attn: After Sales; or scan and email to info@nauticaladventuresbelize.com, no later than 72 hours after receipt of payment of your initial deposit. Please read the full terms below for more information and for other important rights and obligations. Your online acceptance or signature is required and is a condition of this booking so as to confirm the conditions of your charter package.

Important Information for Yacht Charters in Belize

1. Itineraries and Guest Information  

Dates and itineraries that we may provide are indicative only and subject to change. In order to ensure all guests are aware of important information regard your Yacht Charter (such as, but not limited to, chart briefings and safety information and these Terms and Conditions), it is a condition of your booking that you promptly inform us of the names and details of all other guests on your booking and update us immediately should any guest details change. In providing this information to us, you confirm that you have obtained the guests’ express permission to provide us their contact details. We confirm their details will be used in accordance with our privacy policy which can be found on our website, https:///www.nauticaladventuresbelize.com/termsandconditions.

2. How to Book

2.1 To make a booking you can contact us either directly over the telephone by calling the number on our websites or via online booking on our website at www.nauticaladventuresbelize.com. The person making the booking (the "Lead Charterer" or “You”) must be 18 years old or over and possess the legal capacity and authority to make the booking and accepts these booking conditions on behalf of everyone in their party. Whether you book alone or as a group, we will only deal with the Lead Charterer in all subsequent correspondence, including changes, amendments and cancellations. The Lead Charterer is responsible for ensuring the accuracy of the personal details or any other information supplied in respect of all Passengers and for passing on any information regarding the booking or any changes made in relation thereto to all Passengers, including but not limited to information on schedule changes or copies of booking confirmations. The minimum age for an unaccompanied Passenger is 18 years of age on the date of departure. All sums stated in these Terms and Conditions are in US Dollars (USD / $) unless stated otherwise.

DEPOSITS and PAYMENT SCHEDULES

Upon Booking Date:

  • 50% of total booking amount

Prior to Charter Start / Departure Date:

  • Final Balance of total booking amount due within 30 days of your charter start / departure date

Please note that deposits are non-refundable. If complete and final payment is not made by the due date then we reserve the right to cancel your booking, in which case all deposits paid to date will be forfeited. 

2.2 If we accept your booking, we will issue a Booking Confirmation. When you receive the Booking Confirmation please check the details carefully and inform us immediately if anything is incorrect. Names on travel documents must exactly match those in the Passenger's passport. Travel documents will be sent or emailed to you (to the address given to us by the Lead Charterer at the time of booking) after initial deposit is made. It is essential that you ascertain whether or not you can obtain relevant visas and vaccinations before making your booking. We cannot accept any liability for tickets lost in the mail. Travel Documents may be in paper or email form depending on your chosen charter package. You cannot assign or sub-charter your booking without the prior written consent of the Company.

2.3 We may be able to advance register your booking request before the release of the relevant yacht fleet. Requests that are made more than 6 months in advance are subject to availability and prices.

2.4 We will consider special requests when you book. We will tell you whether there is a charge for the request. We can only guarantee requests for which there is a charge, or those that are confirmed in writing. It is your responsibility to advise us of any special requirements. We regret we cannot accept any booking which is conditional upon the fulfillment of a particular request.

2.5 We may not be able to confirm some of your additional travel requests immediately at booking. In these instances we may issue a Booking Confirmation, however, the contract for arrangements that we have not been able to confirm will only be made when we have sent you written confirmation that those additional arrangements have been finalized. We will notify you promptly of any changes to your additional travel requests between the time of booking and the written confirmation, including if there is any change to the price. If any of these changes are not acceptable then you will be entitled to cancel your booking and receive a full refund; provided you notify us within 7 days of receiving details of the changes.

2.6 Your personal safety is of paramount importance to us and therefore it is imperative that you advise us at the time of booking of any condition, medical or otherwise, that might affect your or other Passenger’s enjoyment of the charter.

2.7 To pay your final balance, amend your booking or discuss any other aspect of your charter package booked directly with us, please contact us by calling the number available on our websites. For bookings made through an agent, broker or other third party, please contact your agent directly. 

3. Prices and Surcharging 

3.1 All prices we advertise are accurate as of the date publication, but we reserve the right to change any of those prices from time to time. Prices include a cost for fuel that was estimated at the date of publication. Prices on our website are updated regularly. All price quotations are provisional until confirmed in writing on your Booking Confirmation. Before you make a booking we will give you the up-to-date price of your chosen charter package, including the cost of any supplements, upgrades, or additional facilities which you have requested. In the unlikely event of an administrative error leading to an incorrect price being displayed, we reserve the right to correct it. Offers are not combinable unless expressly stated and may be withdrawn at any time. 

3.2 We reserve the right to impose an additional fee for additional transportation costs imposed between the time of confirmation of booking and your departure date, including without limitation the cost of fuel, dues, taxes, or fees chargeable for services such as embarkation or disembarkation fees at ports and exchange rates. We do not accept responsibility for tourist taxes, resort fees, or similar fees that are charged locally and are not specifically identified as included in your charter package, which must be paid by you and are not included within your chart or tour package price. 

4. If You Change or Cancel Your Charter

4.1 YOUR RIGHT TO A REFUND IS LIMITED. Cancellation / refund requests must be in writing and cannot be made verbally. NO REFUNDS WILL BE ISSUED IN RESPONSE TO VERBAL CANCELLATIONS. Cancelled reservations may be reinstated at the current rates, subject to availability, current package inclusions, and reinstatement fees. Charges and fees for products, services, attractions, or excursions to be supplied in addition to the base charter package are non-refundable. Non-refundable fees include, but are not limited to: returned check fees, reinstatement / cancellation / late payment fees, processing fees, reservation change fees, transfer fees, and travel protection premiums. Please note that destination changes are not permitted in any circumstance. Any change in destination will be treated as a cancellation. The cancellation provisions of paragraph 6 will apply in such circumstances. 

The following cancellation policy and terms apply: 

DEFAULT AND CANCELLATION POLICIES 

The details below outline the cancellation charge as a percentage of the total charter costs associated with the period before the charter start / departure date in which written notice of cancellation is received by us.

More than 30 Days Before Charter Start / Departure Date:

  • 50% of total booking amount

0 - 29 Days Before Charter Start / Departure Date:

  • 100% of total booking amount

Please note: We strongly recommend that you purchase travel insurance to cover your booking and travel arrangements. 

4.2 If, after our Booking Confirmation has been issued, you wish to (i) make a change to your existing booking or (ii) change to another charter, destination, or change departure date, we will try to make the changes subject to availability, provided that notification is received in writing at our offices from the Lead Charterer and subject to the following conditions:

We will not charge you fees to amend your booking in the following circumstances:

  1. To correct an incorrect initial, first name, surname or title
  2. To change your crew members (providing the Lead Charterer does not change)

Should you have purchased anything other than a charter package then other charges may apply and will be advised at the time of your amendment inquiry by us. For example, but not limited to, a change in name for a flight may be treated as a cancellation by an airline and a new ticket will be required to be purchased by you.

  1. For the avoidance of doubt, if the charter you wish to change is, at the time of amendment, cheaper than what you have paid for your original charter, no refund of the difference will be given.
  2. Any amendment permitted under this clause is subject to a maximum of 1 change per booking. No refunds shall be due after an amendment is made and any further amendment(s) will be treated as a cancellation and all money paid will be forfeited.

5. If We Change or Cancel Your Charter

5.1 The arrangements for your charter are made in advance and it is inevitable that changes will sometimes become necessary. We reserve the right to make such changes if they do become necessary. Most of these changes will be minor and we will advise you of them as soon as possible. If major changes (for example: unequivalent boat, new destination, new dates) that might affect the overall standard of your charter are made after your booking (for example: a delay in start / departure date of more than 24 hours), you will be notified as soon as reasonably possible and we will offer you an alternative charter if there is time before your departure. In most cases, we will offer an alternative charter which is the same price, or more expensive than the charter you originally booked. If an alternative charter suggested by us is cheaper, you are entitled to a refund of the price difference. 

5.2 We also reserve the right to recall your charter yacht due to Force Majeure Events (as defined below). If we cancel your charter, except for a Force Majeure Event or as a result of your non-payment of any amounts due under the contract, you are entitled to receive a full refund of all monies paid. For the avoidance of doubt no refund or compensation will be paid if your charter is cancelled due to a Force Majeure Event. 

5.3 We strongly recommend that you do not make travel arrangements to your point of departure or make any connecting travel that is non-refundable or non-changeable or incurs penalties or costs in respect of visas or vaccinations until such time as your travel itinerary has been confirmed on your departure documents. If you make such arrangements which you are then unable to use due to a change in your itinerary we shall not be liable to you for the cost of those arrangements. 

5.4 We reserve the right to refuse to accept a Passenger or remove a Passenger from a charter if that Passenger violates any law, or, in our sole discretion, is disruptive to others, or constitutes a danger to himself / herself or others. In the event the Passenger is so removed or his / her participation terminated, and any / all expenses from being removed or terminated, which include but are not limited to hotel accommodations and a return flight, are the responsibility of the removed passenger. The removed Passenger will not receive any refund for the remaining portion of the charter. If the captain of a yacht or any of our staff or agents, in his / her reasonable discretion, believes that a passenger is disruptive or that he / she is suffering from a contagious disease, they can also refuse to let such passenger proceed with the charter, disembark the Passenger from a yacht, or remove the Passenger from an accommodation or excursion / activity. 

6. Our Liability, Conditions of Carriage and Limitations

6.1 Neither the Company, its affiliates, owners, officers, agents, or employees, shall be held liable for any act, default, injury (including death), loss, expense, damage, deviation, delay, curtailment or inconvenience caused to or suffered by any person or their property, howsoever arising, which may occur or be incurred by any organization or person, where such act, default, injury, loss, expense, damage, deviation, delay, curtailment, or inconvenience may have been caused or contributed to by defects or failures of any aircraft, vessel, automotive vehicle or other equipment or instrumentality under the control of independent suppliers. You further understand that if you purchase any optional activities that are not part of your pre-booked charter package (including, without limitation, shore excursions and tours, however conducted, airline flights and ground transportation), these activities are operated by independent contractors; the contract for the provision of that activity will be between you and the third party provider for such activity; the Company neither owns or operates the third party supplier; and accordingly, you agree to seek remedies directly and only against the third party supplier and not hold the Company responsible for their acts or omissions.

6.2 You understand and acknowledge that your travel on the yacht may involve risk and potential exposure to injury. You also realize and acknowledge that risk and dangers may be caused by the negligence or participation of other passengers. You also recognize and acknowledge that risk and dangers may arise from foreseeable and unforeseeable causes, including weather and other acts of nature. You fully understand and acknowledge that the aforementioned risks, dangers, and hazards are a potential in connection with recreational activities which may take place during the charter of the yacht, and that you are willingly and knowingly electing to sail on the yacht in spite of such potential risk of danger.

6.3 In recognition of the inherent risk of the travels and related activities in which you are intending to engage, you confirm that you are physically and mentally capable of sailing on the yacht, and you willingly and voluntarily assume full responsibility for any injury, loss, or damage caused by you. It is your responsibility and obligation to inform the Company, at the time your booking is made, of any medical or physical disability or limitation that might disable you or render you unable to perform or safely sail on the yacht. Your failure to do so will release us from any liability for loss, damages, or other compensation arising from or related in any way to such disability or condition. You further acknowledge that you are the best judge of your own conditions and limitations and that it is incumbent upon you to fully disclose the full extent of any such conditions or limitations to the Company.

6.4 In consideration of the services and arrangements provided by the Company, you, for yourself, other Passengers on your charter, and for your heirs, personal representatives or assigns, do hereby release, waive, discharge, hold harmless, and agree to indemnify the Company, and its owners, officers, directors, employees and affiliates from any and all claims, actions, or losses for emotional injury, bodily injury, property damage, wrongful death, loss of services, lost profits, consequential, exemplary, indirect or punitive damages or otherwise which may arise out of or occur during your charter activities conducted in conjunction therewith and shall include, without limitation, any loss caused by breakage of shafts or any defect or unseaworthiness in hull, machinery or appurtenances, equipment, furnishings, supplies or officers or crew of the yacht or its launches or watercraft; fault or neglect of the Skipper, tugs, officers or members of the crew, agents, servants, independent contractors; the quality, nature, or consequences of medical or surgical treatment; your negligence or caused by your breach of this charter; or which results from your acts, omissions or defaults or any person acting on your behalf , or which results from the acts, omissions or defaults of, or any claims asserted by, the other Passengers on the yacht. The Company is not liable for injury, illness, or death of any Passenger unless directly caused by the negligence or willful misconduct of the Company. Regardless of the situation or circumstances giving rise to a claim, you waive any right to seek consequential, punitive, or exemplary damages against the Company, its owners, directors, officers, employees, agents, and affiliates, for any reason whatsoever.

6.5 The Company’s maximum liability, for any reason whatsoever, will be limited to the amount paid by you to the Company for the charter. If any international convention applies to, or governs, any of the services or facilities included in your charter arranged or provided by us and you make a claim against us of any nature arising out of death, injury, loss, or damage suffered during or as a result of the provision of those services or facilities, our liability to pay you compensation and / or the amount (if any) of compensation payable to you by us will be limited in accordance with and / or in an identical manner to that provided for by the international convention concerned (in each case including in respect of the conditions of liability, the time for bringing any claim, and the type and amount of any damages that can be awarded). For the avoidance of doubt, this means that we are to be regarded as having all benefit of any limitations of compensation contained in any of these Conventions or any other international conventions applicable to your charter. Other than as set out above, and as is detailed elsewhere in these Terms and Conditions, we shall have no legal liability whatsoever to you for any loss or damage.

6.6 In the event medical care becomes necessary on your charter, you may be hours or days travel by water, porter, or other non-vehicular transportation from any medical facility. The medical facility you may be treated in may not have the same standards as hospitals or doctor’s offices in your home country. The medical personnel you will be treated by may not speak fluent English and have the same training as medical personnel in your home country. You further acknowledge that an emergency evacuation may be unavailable, expensive, and delayed at your yacht location, and that the medical facilities and attention available aboard the yacht are limited. Decisions are made by the Company staff based on a variety of perceptions and evaluations of the situation at hand. Participant understands and agrees to abide by these decisions.

6.7 You agree that no suit shall be maintained against the Company for emotional or physical injury, illness or death, unless written notice of the claim, including a complete factual account of the basis of such claim, is delivered to the Company within 180 calendar days from the date of the incident giving rise to such injury, illness or death; and no suit shall be maintainable unless commenced within one (1) year from the day of the incident giving rise to such injury, illness or death, notwithstanding any provision of law of any state or country to the contrary.

6.8 To the full extent permitted by law, we exclude all representations, warranties or terms (whether express or implied) other than those expressly set out in these booking conditions.

6.9 Force Majeure: Without limitation, we are not responsible for, and no refunds will be given for, delays or cancellation of all or part of your trip due to causes or circumstances beyond Our responsibility or control, including but not limited to acts of God; perils of the sea, harbors, rivers, or other navigable waters; act of any governmental or ruling authority; epidemic; collision; stranding; fire; war; hostilities; riots; strikes or labor stoppages; or any other cause or circumstance beyond Our responsibility or control (a “Force Majeure Event”). For the avoidance of doubt, a Force Majeure Event also includes (a) the occurrence of any pandemic, epidemic or prevalent disease, or illness with an actual or probable threat to human life as may be designated or determined by any local, city, county, district, or state governmental entities, as applicable, or the federal government of the United States, Belize, the World Health Organization (WHO) or the U.S. Centers for Disease Control (CDC); including, without limitation, coronavirus, atypical pneumonia, Severe Acute Respiratory Syndrome (SARS), or avian influenza, or (b) adherence to any travel restriction, warning or advisory issued in relation thereto by any local, city, county, district, or state governmental entities, as applicable, or the federal government of the United States, Belize, the World Health Organization (WHO) or the U.S. Centers for Disease Control (CDC), or (c) any quarantine or similar measure taken in relation thereto by any governmental agency or authority to prevent the spread of any communicable disease, or (d) any unavailability of any resources, information or services resulting from any of the foregoing including, without limitation, the unavailability of resources, information or services due to any government shutdowns or the unavailability or resources, information or services due to a shutdown, quarantine, or similar measure of any third-party service provider whose service or information is relied upon to operate the trip or otherwise fulfill its obligations under this Agreement.

7. Yacht Charters Information

You have the right to inspect the yacht, her gear, and inventory before departure and to ensure that all items are present and in good working conditions. Following the conclusion of your charter, the yacht must be returned at the time and place specified by us and in the same condition in which it departed, subject to normal wear and tear, or defects which are agreed and noted at inspection. If the yacht returns late at the end your charter as a result of you or your party’s acts or omissions, you will be liable to pay a pro rata charter fee for use of the Yacht, plus consequential and incidental losses suffered by the Company caused by the delay. You agree to abide by the judgment of the crew as to the sailing, weather, anchorages, and other pertinent matters with regards to the charter of the yacht.

The Company and its crew cannot be held responsible for under age consumption of alcohol.
Use of the yacht is for pleasure only. The yacht shall not transport merchandise or carry passengers for pay without the prior written consent of the Company. No pets are permitted on board unless otherwise stipulated.

8. Equipment and Yacht Insurance Coverage

8.1 You are strongly advised to insure yourself against any possible risk that may occur and in particular to ensure that you have sufficient insurance in respect of dependent relatives and Force Majeure Events. The company cannot be held responsible for any loss which you may suffer as a result of you providing incorrect information (such as, by way of example only, due to your negligence, deliberate default, or willful misconduct). Adults will at all times be responsible for minors in their charge.

8.2 The Company agrees to insure and keep insured the yacht against public liability and marine public liability to such an extent as the Company in its absolute sole discretion shall deem appropriate. Such insurance policy does not cover loss of life (except that caused through the negligence of the Company), or damage to or loss of property of any person on board against which you must insure prior to the charter.

9. Yacht Damage

9.1 In the event you or your party cause damage or loss to the vessel (howsoever caused) or to property belonging to a third party you will be liable for the damage.

9.3 If you or your party cause damage or loss to the vessel, any ancillary equipment or to property belonging to a third party and such damage or loss is caused as a result of your gross negligence or reckless conduct you will be liable for the full extent of the loss suffered. Regardless of the circumstances, if the damage caused by your or your party renders, in the Company’s opinion, the Yacht no longer fit for charter use then we will withdraw the Yacht. In such circumstances you will not be offered a replacement Yacht; alternative accommodation or any form of compensation or refund whatsoever.

10. Your Responsibilities

10.1 You are responsible for ensuring that you possess all the necessary documentation including passports and visas for your charter. For all destinations, you should consult the appropriate consulate. All Passengers must have a valid passport for international travel. Many countries require passports to be valid for six (6) months beyond your stay. Visa and entry permits are required for many countries. Passports, visas and re-entry permits are the responsibility and cost of the Passenger. We recommend that you check travel advisories and health and medical information, for your destinations. WE CANNOT ACCEPT RESPONSIBILITY FOR ANY FAILURE BY A PASSENGER TO COMPLY WITH ANY TRAVEL DOCUMENTATION OR VACCINATION

REQUIREMENTS OR ANY COSTS OR FINES BEING INCURRED BY SUCH PASSENGER IN CONNECTION THEREWITH. PASSENGERS WHO ARE DENIED ENTRY FOR IMPROPER DOCUMENTATION/FAILURE TO PROVIDE REQUIRED INFORMATION OR FAILURE TO COMPLY WITH MANDATORY HEALTH REQUIREMENTS RECEIVE NO REFUND.

10.2 In the event a U.S. or government agency issues a full ban on travel to your destination, we reserve the right to offer alternative destinations or issue travel credit in lieu of a refund. There will be no refunds due to fear of travel from actual, threatened, or perceived violence or terrorist events.

Without prejudice to the above please bear in mind it is your responsibility to understand entry requirements for the destination. We are obligated to follow local laws and regulations, as are you, and such local laws and regulations.

TERMS OF USE

What you are allowed to do

You may access this Web site to obtain information, check suitability, availability and to make legitimate reservations or purchases of vacations, and related products and services.

You may print off one copy only of any individual page for your own personal use. This includes making copies solely for the purpose of storing the same into a cache memory or copies made when the file is downloaded, as long as you do not do any of the things detailed under "What you are not allowed to do".

What you are not allowed to do

You are not allowed to copy any material from this Web site for any other commercial purpose.

You are not allowed to remove any copyright, trademark or other intellectual property notices or watermark contained in the original material or from any material copied or printed from the Web site.

You are not allowed to copy (whether by printing onto paper, storing on disk or any other way), distribute (including distributing copies), tamper with or alter in any way or otherwise use any material contained in this Web site except as set out above in "What you are allowed to do".

You are not allowed to use the Website for any activities that breach any laws, infringe any other parties’ rights, or breach any standards, content requirements or codes published by any relevant authority.

You are not allowed to use the site in any way that interferes with our systems, other users or

You must read the relevant Booking Terms and Conditions before booking any vacation and be familiar with the relevant cancellation policy. If you book any other product or service you must make sure you are aware of and accept any conditions that apply to that product or service.

Ownership, Copyrights and Trademarks

This Web site consists of images, texts, formats and styles of presentation, software (including HTML code) and material analogous to it ("Material"). All copyright and other moral, ownership and intellectual property rights capable of subsisting in the Material or derivatives of it from time to time is either owned exclusively by or is licensed to Nautical Adventures Belize or one of its subsidiary companies.

You acknowledge our rights to the Material. Save as provided elsewhere in these Terms you must not copy, modify, manipulate, transmit, perform, publish, display license or create derivative works from Material accessed through this Web site. Where copying or transmission is expressly permitted, you must not display any author attribution or copyright notice.

This Web site also contains certain trademarks of Nautical Adventures Belize or its subsidiaries or affiliates (whether granted or applied for), graphics, logos and service names ("Devices"). The Devices are owned exclusively by Nautical Adventures Belize or a subsidiary and may not be copied or reproduced in any format (save as provided elsewhere in the Terms), or used in connection with any product or service without prior consent of Nautical Adventures Belize or in any manner that is likely to cause confusion among customers, disparages or discredits Nautical Adventures Belize or a subsidiary. All other trademarks not owned by Nautical Adventures Belize or its affiliates that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Nautical Adventures Belize or its affiliates.

Changes to these Terms and Conditions

We may at any time change or modify all or any part of these Terms. By browsing this Web site you are accepting that you are bound by the terms and conditions and disclaimer current at that time, so you should check these each time you visit the site.

Please note that these Terms are distinct and separate from the Booking Terms and Conditions (or other specific conditions) that must be accepted by you before we agree to offer any charter or related products or services to you through this Web site. If you have any questions, please feel free to contact us.

Customer's Responsibility

You represent that you are of sufficient legal age to use this site, and to create binding legal obligations for any liability you may incur as a result of the use of this site. You understand that you are financially responsible for all uses of this Web site by yourself, and those using your login information.

This privacy policy explains how we, Nautical Adventures Belize, collect and use your personal information. What information might we collect about you?

We do our best to minimize the information we collect about you. For example, if you’re booking a charter or tour with us, we are likely to ask for more information than if you’re only requesting a brochure or browsing our website (the “Site”). We may collect, use, store, and transfer different kinds of personal information about you, including the following:

• Details about you: Your first and last name, marital status, title, gender, email address, telephone number, date of birth, loyalty membership details, your reasons for travel, meal, and other travel preferences or dietary requirements.
• Payment details: Your bank details and payment card details when making a booking with us. Details about payments to and from you and other details of products and services you have purchased from us.
• Identification documents: This applies, for example, if you are traveling on a sailing route requiring advance passenger information and could include your passport or identity card details including your passport number, the country in which your passport was issued, and the expiry date.
• Details about your booking with us: Details such as where you are flying from and to, your booking information (including anyone else on the booking), any onward travel details if relevant, details of experiences or excursions booked through us, baggage requirements, upgrade information, lounge visits, seat preferences, meal preferences or requirements, details of any special assistance required and any other relevant information for us to provide you with the travel or other services you have arranged with us.
• Details from your interactions with us: Information about interactions or conversations with us and our staff, including when you make inquiries, comments, complaints, or submit feedback to us. This also could include username and password and your interests, marketing preferences, survey responses, and information regarding web pages visited as part of our Site.
• Your use of our systems and services: This includes how you use our Site, retail stores, call centers, and/or social media pages, IP addresses, and information you may post on social media.
• Job applications: If you apply for a job with us, your CV, work history, educational details, and the role you are applying for.
• Special types of data: In certain circumstances, we may need to collect information from you that is deemed sensitive. For example, we might collect:
– Data about your health. Knowing your dietary requirements and any medical conditions you have will ensure that the trip is suitable for you and any necessary adjustments are made.

If you fail to provide personal data

Uses of your information

We use personal information for operational, legal and other reasons such as:

• To manage your booking with us. We will use your information to provide you with any travel or event services that you request or purchase. This entails booking your flights, accommodations/yacht charter, organizing tours, transportation, and car hire and providing you with your tickets and providing you with any special assistance you require.
• To contact you with information about your bookings and support services. We will use your contact details to send you communications that relate to your booking or services you have requested. The types of information usually included would be: emails responding to inquiries, providing you with tickets, alerting you to changes in itineraries, or responding to any complaints you have.
• To provide assistance with online bookings. We may collect information when you enter it into forms on our Sites but do not complete your booking, for example, in case you are experiencing difficulties using our Site.
• To enable you to partake in a prize draw, competition or complete a survey.
• To send you marketing communications. We will use your information to contact you in order to keep you up to date with the latest news, offers, events, sales, brochures, promotions, and competitions that we consider may be of interest or relevant to you. When will we get in touch with you?

One of the other reasons we sometimes collect your information is so that we can form a view on what we think you may want or need, or what may be of interest to you. With this information, we decide which products, services, and offers may be relevant for you and what marketing may interest you.

We keep you up to date with our latest offers, partnerships, sales, promotions, competitions (or those of our partners such as other members of the Travelopia group) that we think might be of interest/relevance to you.

We will only contact you in this way if:

• You have signed up to receive marketing communications from us or one of the other Nautical Adventures Belize companies and have not later told us that you don’t want to hear from us.
• You have made a booking with us and have not told us that you do not want to hear from us.

What if you don’t want to receive marketing?

We never want to send our marketing to someone who isn’t interested in receiving this content. If you have decided that you no longer wish to hear from us, you can unsubscribe from marketing by clicking on the ‘unsubscribe’ link included in all of our emails or by contacting us

Third parties and marketing

We do not pass your information to other parties for marketing purposes unless you agree to us doing so. We will get your express opt-in consent before we share your personal data with any company outside the Nautical Adventures Belize group of companies for marketing purposes.

Sometimes we may use 3rd parties to send the communication to you on our behalf. We use third-party providers to deliver our brochures and monthly e-newsletters respectively. However, these companies do not have the right to send marketing to you for their own purposes.

The marketing material we send to you may occasionally also include information about selected business partners who provide services closely related to our own product.

When do we share your personal data?

In order to provide you with the services, we may share your personal information with third parties such as:

• Third-party suppliers we work with to provide your booking and our other services to you. We share your information with parties such as travel agents, booking agents, airlines, hotels, tour operators, transport companies, excursion providers, airport authorities, insurance companies, car hire companies, ground handling agencies, and cruise companies.
• Other suppliers that we work with in connection with our business. We share your information with third-party suppliers that we use to provide services in connection with the experiences we offer to you. This might include marketing agencies and/or companies that run our marketing campaigns, IT developers, service providers and hosting providers, third parties that manage promotions or competitions, third party software companies, ground agents, site analytics providers, medical service providers, and credit card screening companies.
• Airports, immigration/border control, and/or other government authorities. Sometimes we have to provide “Advance Passenger Information” about you to border or immigration authorities of the country of your travel destination. This would usually be the basic information contained in your passport, but the laws of certain countries may require additional information. We will provide this information when we are required to do so.
• Third parties/other Nautical Adventures Belize companies for marketing. Your personal data may be processed on our behalf by our trusted third-party suppliers to assist and help us in consumer classification, which enables more accurate and relevant marketing. We also may share your information with third parties for marketing purposes. We may share personally identifiable information and non-personally identifiable information internally with our sister-brand. We do this in order to enhance your customer experience.
• Credit references and fraud prevention agencies.
• Courts or advisors. We may have to share your information with other third parties (such as legal, accountants or other advisors, regulatory authorities, courts, and government agencies) to enable us to enforce our legal rights or to protect the rights, property or safety of our employees or where such disclosure may be permitted or required by law.
• Third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them.
