Guest Release & Assumption of Risk Agreement

Please read this before your trip. You will be asked to sign this agreement before boarding. By signing, you accept the risks of the activity and give up certain legal rights, including the right to sue.

In exchange for being welcomed aboard to enjoy the marine excursions operated by Nautical Adventures Belize Ltd. (“NAB,” the “Company”), together with the vessel, tender, equipment and facilities we provide (the “Activities”), I, the Primary Guest named below, agree on behalf of myself and everyone in my party — including all accompanying adults, minors, and their parents or legal guardians (together, the “Guests”) — to the following, to the fullest extent permitted by the laws of Belize:

• Signing for my party. I am at least 18 years old and I have authority to accept this Agreement for everyone in my party, including any minor and that minor’s parent or guardian. My signature binds all Guests as if each had signed, so no one else needs to sign.
• Waiver of claims. I waive any and all claims that I, any Guest, or anyone acting on our behalf may have against the Company, its owners, directors, related entities, employees, agents, officers, captain, crew, and the Company’s insurers (the “Released Parties”) for any loss, damage, injury, or death arising from the Activities.
• Assumption of risk. I and every Guest accept all risks of the Activities and of using the vessel and equipment, including risks caused by the negligence of the Released Parties. I understand the Activities carry inherent risks — both foreseen and unforeseen — that can include serious injury, drowning, and death, such as those from captain, operator or crew error, changing weather and sea conditions, boarding and disembarking, swimming and snorkeling, marine life, and equipment failure.
• Release. I and every Guest release the Released Parties from all liability for any loss, damage, injury, death, or expense that we (or our next of kin) may suffer arising from the Activities, including any claim arising from their negligence. This does not release conduct found to be gross negligence or intentional wrongdoing.
• Indemnity. I and every Guest agree to indemnify and hold harmless the Released Parties from any liability, loss, damage, injury, death, or expense arising from participation in the Activities or use of the vessel or equipment.

Being ready for the trip

I confirm that no Guest has a physical or mental condition that makes participation unsafe, and that no Guest is taking part against medical advice. Participation is voluntary, and each Guest has had the chance to inspect the vessel and equipment. Guests agree to attend the safety briefing and to follow the captain’s and crew’s instructions at all times, and to report right away anything that seems unsafe.

No Guest will board or take part in any in-water activity while intoxicated. Where the Company serves alcohol, it is for adults of legal drinking age only and at the captain’s discretion. I have disclosed any Guest who is a non-swimmer or weak swimmer, and I understand the captain may require a life vest or limit in-water activity for safety.

Photos and video

I give the Company permission to take photos and video of the Guests during the Activities and to use them for any lawful purpose, including publicity, advertising, and website or social-media content, without payment.

Governing law

This Agreement is governed by the laws of Belize, and I and every Guest agree that the courts of Belize have exclusive jurisdiction over any dispute relating to the Activities or this Agreement. If any part of this Agreement is held invalid, the rest remains in full effect.
